Civil Liability and Compensation in a Hit and Run Accident Case

“Hit and run traffic accident are more severe than any ordinary traffic accident, because the responsible driver has fled the scene.

According to New York Car Accident Lawyer, Paul Ajlouny, “This is now an intentional or reckless act causing harm — a criminal act”. In New York the victim is covered under No-Fault insurance.

No-fault insurance pay medical bills and lost earnings when an individual is injured in from a car accident, regardless of who was at fault for the crash. A no-fault claim is typically made through the personal injury protection (PIP) provisions of a car insurance policy. New York is a no-fault state.

New York Hit and Run. “didn’t see” The Victim Doesn’t Fly!

In New York City, most drivers who hit people with their vehicle and then flee the scene are rarely ever charged with a crime. The police fist of all need to find them to make an arrest, in order to get a hit-and-run conviction, according to New York state law.

In any case prosecuting attorneys still need to prove a driver knew he or she hit someone and caused injury. Story at the intersection is, that pedestrian accidents in New York are dropped, or just not pursued at all, once a driver claims he “didn’t see” the victim. Have they though?

Since the beginning of 2016 there are there have been 4 hit and runs to count so far.

  • Just this Friday morning, Jan 22, 2016 12:12 pm, a 15-Year-Old Boy In Critical Condition Following Williamsburg Hit-And-Run.
  • A 29-year-old man was fatally struck by a hit-and-run driver while crossing northbound lanes of the FDR in Kips Bay on January 8, 2016.
  • Another hit-and-run driver careened into the Gowanus Canal on Monday, January 18, 2016, after striking another vehicle on Court Street.
  • On Thursday, officers arrested the driver of a Ryder rental truck who they say fatally struck a cyclist in Sheepshead Bay on Tuesday.

New York has adopted hit-and-run civil penalties depend on the drivers’ word.

Increasing penalties for drivers who leave the scene of a crash without reporting it. How many hit-and-runs there have been so far this year in New York City.

NYPD Reports a whopping 34,000 hit and flee accidents. 4,000 of those “personal injury”, leaving the scene. 48 of the 4000 were considered “catastrophic injury”.

Think about that number 4,000 personal injuries in which a driver injured or killed someone in New York and then fled.

2015 Statistics according to NYPD reports:
48 catastrophic hit-and-runs
28 suspects were arrested
480 arrests
475 moving summonses.

According to New York car accident lawyer Paul Ajlouny,  with the law firm of Ajlouny Injury Law,  “Fleeing the scene of an accident where a person is fatally struck should never be down-played! Pedestrian lives matter — All lives matter, there’s no excuse for fleeing the scene of an accident!” says Mr.Ajlouny.
