According to Gersh Kuntzman, a NYC cyclist, pedestrian and driver, New Yorker’s risk their lives every time they leave their apartments on foot, in a car or on a bike. New Y0rk Roads and sidewalks are still  dangerous even with the Vision Zero initiatives in place. Mr. Kuntzman has drawn up a basic set of rules, a constitution, by which, all (drivers, cyclists, and pedestrians) should abide by in order to stay safe, to stay alive (lest we all kill and maim each other and our streets run even more slick with blood.)

“We the Users of the Streets of the City of New York — the Drivers, the Pedestrians, the Cyclists — in order to form a more perfect Understanding, establish Rules, insure roadway Tranquility, provide for the common defense, promote the reduction of transportational Warfare, and secure the Blessings of Safety to ourselves and our fellow Users, do ordain and establish this Constitution.”

Kunzman’s objective was to craft a Constitution in hopes of reducing violence on the New York streets.  WHY? He is sick of watching so many near-misses every day. Please send all proposed amendments to gkuntzman@nydailynews.com to be brought up at the next Constitutional Convention.

Increasing bike paths and bike safety is part of the Mayor’s Vision Zero initiative to reduce the number of traffic related fatalities and is also a key strategy of the Health Department to build neighborhoods that encourage physical activity. Through the Health Department’s Center for Health Equity, the agency is committed to investing in undeserved communities and eliminating the health inequities in New York City.

Data reported by Streets Blog reported seventeen people died in New York City traffic in July, and 5,310 were injured, according to City Hall’s Vision Zero View crash data map. 83 pedestrians and cyclists killed by city motorists through July of 2016, and 8,378 injured, compared to 77 deaths and 7,835 injuries in the same period in 2015.

Citywide, nine pedestrians and three cyclists were fatally struck by drivers last month. Among the victims were Teresa Martinelli, Matthew von Ohlen, Jorge Zepeda, Andrew Esquivel, Sean Ryan, Terrence Montrose, Roberts Nukheimra, Jack Koval, Antonio Flores, and an unnamed male pedestrian in the Bronx.

Motorists killed at least one senior in July: Teresa Martinelli, 79. Across the city, 727 pedestrians and 498 cyclists were reported hurt in collisions with motor vehicles. Per NYPD policy, few of these crashes were investigated by trained officers.

Hit-and-Run Drivers Are Still Killing NYC Pedestrians

While the de Blasio administration touts 2016 as a year in which the Vision Zero initiative continued to drive down traffic deaths — down four percent from 2015 to 225, and down from 300 deaths in 2013 — all of this year’s gains were made in the category of drivers or passengers. For pedestrians and cyclists, it was another story altogether: according to NY1, 140 pedestrians were killed on city streets, a slight rise from the year before, while eighteen cyclists were killed, up four.

Most alarming: a sharp spike in the number of pedestrians killed by hit-and-run drivers, which jumped by 34%. During the first three days of 2017, there were three separate incidents of fatal hit-and-runs alone. And drivers are getting away with it: in a report released by the NYPD last September, only 13 arrests were made after 38 deadly hit-and-runs during FY 2016. In 22 instances where someone was seriously hurt, just 14 arrests were made.

According to New York Car accident lawyer Paul Ajlouny, “You turn on the news and just about everyday, pedestrian are struck by a car. Statistics indicate pedestrians are struck by cars more than 150,000 times a year. Every two hours, one is killed.” states Mr. Ajlouny. “Often times the cause of the accident diver distraction. Pedestrian also need to take responsibility by putting away their phones while walking.”
