$14 Million Verdict For Driver Injured In Crash
A Brooklyn ambulette driver won a $14 million verdict from Careful Bus Service (school bus transportation service for children), after one of its mini-buses smashed into his vehicle, fracturing his hip and causing him to have a seizure.
Arkadiy Korsunskiy, 70, was driving his ambulette down Prospect Park West on Feb. 28, 2008, when a Careful bus plowed into him, crumpling the rear of his vehicle and throwing him into the car in front of him.
Lawyers for Careful Bus argued that Korsunskiy had hit the vehicle in front of him before the bus hit him, but the jury believed Korsunskiy and awarded him the whopping verdict.
Korsunskiy was awarded $6 million for past pain and suffering and $4 million for future pain and suffering. The rest was for future medical bills and $2.5 million for his wife.
Neil Hoffman, the owner of Careful Bus Service, said all his vehicles have controls that restrict their speed, adding that his company’s name is woefully ironic in cases like this.
Rear end collision can cause serious injury. 99% of the time the driver of the car that rear-ends the other car is almost always considered to be at fault. In this case the driver of the car that was rear-ended filed a claim against the driver who hit him, the drivers company was held responsible for all damages to the other driver.
